1) Who we are
These Terms of Service (“Terms”) govern your access to and use of the websites, forms, content, and services operated by GAH Buy Right (“GAH Buy Right,” “we,” “us,” or “our”).

By using our site or services, you agree to these Terms. If you don’t agree, please don’t use the site or services.
2) What we do (and what we don’t)
We provide independent buyer coaching/consulting for residential, commercial, and investor clients.
We are not acting as your real estate broker or agent unless expressly stated in a separate written agreement.
Our coaching is educational and advisory in nature and not legal, tax, accounting, or financial advice. You should consult qualified professionals (attorney, CPA, lender, inspector, etc.) before making decisions.
3) Eligibility
You must be at least 18 and able to enter a binding contract. You agree to provide accurate information and to use the services only for lawful purposes.
4) Engagements, bookings, and communication
Discovery calls / bookings: Scheduling may be handled via third-party tools (e.g., Calendly). Times are not guaranteed until confirmed.
Cancellations / rescheduling: Please cancel or reschedule at least 24 hours before your session. Missed or late cancellations may be forfeited or billed at our discretion.
Communication: We aim to reply within 24 business hours (Mon–Fri, 9:00–5:30 ET). Actual response times may vary.
5) Fees, payment, and refunds
Pricing: Program, flat-fee, percentage, or hourly rates are quoted in writing (email, invoice, or order page). Taxes/processing fees may apply.
Payment: Unless otherwise stated, fees are due upfront prior to delivery. We may use third-party processors.
Refunds: Due to the nature of consulting, fees are generally non-refundable once work begins or materials are delivered. We may issue a partial or full courtesy refund at our sole discretion.
Chargebacks: You agree not to file chargebacks without first contacting us to resolve any issue.
6) Your responsibilities
You are solely responsible for your purchase decisions and outcomes. You agree to:
(a) provide timely, accurate information;
(b) make your own independent evaluations;
(c) verify facts with appropriate professionals; and
(d) comply with all laws, HOA rules, zoning, lender requirements, and contract terms.
7) No guarantees
Real estate markets involve risk. While we may model scenarios, provide checklists, or flag red flags, we do not guarantee approvals, valuations, inspection results, returns, savings, profit, or any specific outcome.
8) Third-party tools & content
Our site and services may link to or integrate third parties (e.g., mapping, analytics, booking, forms, payment, MLS data, comps).
We are not responsible for third-party sites, data accuracy, policies, or availability. Your use of third-party tools is governed by their terms and privacy policies.
9) Intellectual property
All content on our site and in our deliverables—text, graphics, brand elements, tools, templates, checklists, spreadsheets, and training materials—is owned by GAH Buy Right or its licensors and is protected by law.
We grant you a personal, non-transferable license to use materials we provide solely for your internal, non-commercial decision-making. You may not copy, resell, publish, or create derivative works from our materials without written permission.
10) Testimonials and user content
If you submit reviews, testimonials, or feedback, you grant us a royalty-free, worldwide license to use, reproduce, and display that content in connection with our marketing (we may abbreviate last names or use initials). You represent you have the rights to what you submit and that it is accurate and lawful.
11) Acceptable use
Don’t misuse the site or services. Prohibited conduct includes:
Illegal, harmful, or fraudulent activity
Scraping, reverse engineering, automated access beyond normal browsing
Infringing, defamatory, or misleading content
Attempting to bypass security or interfere with the site
We may suspend or end access for violations.
12) Privacy
Your use of the site is also governed by our [Privacy Policy] (posted separately), which explains what we collect and how we use it. By using the site/services, you consent to our data practices as described there.
13) Disclaimers
THE SITE AND SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE.”
TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.
We do not warrant that the site will be uninterrupted, secure, or error-free, or that information is complete or current.
14) Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, GAH BUY RIGHT WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR LOST PROFITS/REVENUES, EVEN IF ADVISED OF THE POSSIBILITY.
OUR TOTAL LIABILITY FOR ANY CLAIMS RELATING TO THE SERVICES OR THESE TERMS WILL NOT EXCEED THE AMOUNT YOU PAID TO US FOR THE SERVICES IN THE 12 MONTHS BEFORE THE CLAIM AROSE.
Some jurisdictions do not allow certain disclaimers/limits; in that case, they apply to the maximum extent permitted.
15) Indemnification
You agree to indemnify and hold harmless GAH Buy Right and our owners, contractors, and partners from any claims, damages, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising out of or related to:
(a) your use of the services;
(b) your decisions or transactions;
(c) your breach of these Terms; or
(d) your violation of any law or third-party rights.
16) Governing law; venue; disputes
These Terms are governed by the laws of the State of New York, without regard to conflict-of-laws rules.
Informal resolution: Contact us first; we’ll try to resolve quickly.
Arbitration: Except for claims that may be brought in small-claims court, any dispute will be resolved by binding arbitration on an individual basis under the AAA rules. Class actions and jury trials are waived. The seat of arbitration is New York, NY.
Injunctive relief: Either party may seek injunctive relief in court to protect IP or confidential information.
If arbitration is found unenforceable for a claim, the exclusive venue will be the state or federal courts located in New York County, New York, and you consent to personal jurisdiction there.
17) Changes to the services or Terms
We may update the site, services, or these Terms at any time. If we make material changes, we’ll post the updated Terms with a new “Effective date.” Your continued use after changes means you accept the updated Terms.
18) Severability; waiver; assignment
If any provision is found unenforceable, the rest remain in effect. Our failure to enforce a provision is not a waiver.
You may not assign your rights or obligations under these Terms without our written consent; we may assign to an affiliate or in connection with a merger, sale, or reorganization.
19) Force majeure
We’re not liable for delays or failures due to events beyond our reasonable control (e.g., outages, natural disasters, war, labor issues, government actions).
20) Entire agreement
These Terms, together with any signed engagement letter/order and our Privacy Policy, are the entire agreement between you and GAH Buy Right regarding the services and supersede prior communications.
